1. Agreement to Terms
These Terms of Service (the "Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and MK Health & Beauty ("we," "us," or "our"), concerning your access to and use of the mkhealthbeauty.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site" and the "App").
You agree that by accessing the Site or App, you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and App and you must discontinue use immediately.
2. Services & Distributor Role
MK Health & Beauty is an authorized distributor of high-quality premium micronutrients manufactured by FormMed HealthCare GmbH. Our services include providing expert consultation, detailed product information, and a seamless platform for purchasing these specialized health products.
We act as a bridge between the high-standard German manufacturing excellence of FormMed and our global community of health-conscious consumers. By using our Site/App, you acknowledge that while we facilitate the sale, the manufacturing standards and laboratory guarantees are provided by FormMed HealthCare GmbH.
3. Eligibility & User Accounts
The Site and App are intended for users who are at least 18 years old. If you are under 18, you are not permitted to register for the Site or App or use the Services without parental consent.
To access certain features, you may be required to register an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for any activities or actions under your account. We reserve the right to remove, reclaim, or change a username you select if we determine it is inappropriate.
4. Ordering & Pricing
Order Acceptance: All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order at any time for reasons including but not limited to: product availability, errors in the description or price, or suspected fraud.
Pricing: Prices for our products are subject to change without notice. All prices are displayed in Euros (€) and include statutory VAT where applicable. Shipping costs will be clearly presented at checkout before final payment.
5. Shipping & Delivery Policy
Products are dispatched directly from our logistics centers in Germany or through our authorized local hubs. We aim to process all orders within 24-48 business hours. Delivery timelines are estimates provided by our logistics partners (DHL, UPS, etc.) and are not guaranteed.
International Shipping: You are responsible for any customs duties, taxes, or import fees levied by your home country. We are not liable for packages held or destroyed by local customs authorities for failing to meet destination country import regulations.
6. Return & Refund Policy
Your satisfaction is our priority. As a consumer in the EU, you have the right to cancel your order within 14 days of receipt for any reason. However, due to health and hygiene reasons, micronutrients and dietary supplements can only be returned if the safety seal is unbroken and the packaging is in its original, unopened condition.
To initiate a return, please contact info@mk-health-and-beauty.com with your order number. Return shipping costs are the responsibility of the customer unless the product arrived damaged or incorrect.
7. Intellectual Property Rights
Unless otherwise indicated, the Site and App are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site and App (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
8. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will MK Health & Beauty, its partners (including FormMed), or its employees be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services.
9. Governing Law
These Terms shall be governed by and defined following the laws of Germany. MK Health & Beauty and yourself irrevocably consent that the courts of Munich, Germany shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
